7.2 Policy Scope

This Policy applies to sexual harassment in the College’s education programs or activitiesi.e., on campus or at locations or events, or under circumstances over which the College exercises substantial control over both the respondent and the context in which the sexual harassment occurs, and includes any building owned or controlled by a student organization that is officially recognized by the College. It applies to face-to-face encounters, social media, and other forms of electronic communication.

This Policy applies to allegations of sexual harassment made against any person in the United States, including any member of the College community, by a member of the College community in connection with any education program or activity, including any person participating in or attempting to participate in the College’s education programs or activities.

Any person may report sex discrimination and sexual harassment in accordance with this Policy (whether or not the person reporting is the person alleged to be the victim of conduct that could constitute sexual harassmenti.e., the complainant). Any person participating in or attempting to participate in the College’s education programs or activities may file a formal complaint of sexual harassment in accordance with this Policy. This Policy applies regardless of gender or sexual orientation, as complainants and respondentsi.e., the individual who has been reported to be the perpetrator of conduct that could constitute sexual harassmentmay be female, male, non-binary, straight, gay, lesbian, bisexual or transgendered students.1 For example, both male and female students can be complainants of sexual harassment, and the complainant and respondent can be of the same sex.
