9.23 Returning from Leave

Ordinarily, on return from FMLA leave, employees will be placed in their previous position or an equivalent position with equivalent pay and benefits.  If, however, an employee fails to return to work at the end of the leave, their employment may be terminated.  In addition, an employee returning from FMLA leave will have no greater rights to job restoration or any other benefits than if the employee had been continuously on the job instead of on leave.  Further, the College reserves the right to deny leave reinstatement to “key employees” where such denial is necessary to prevent substantial economic injury to the College’s operations. You should contact Human Resources to confirm your intention to return to work at least 2 business days prior to the date your leave expires.
